These Terms of Use ("Terms") govern your access to and use of the EquiEdge mobile application (the "App") and the website at equiedge.xyz (the "Site"). EquiEdge is an AI-powered horse racing analysis tool for Australian thoroughbred meetings. By downloading, installing, or using the App or Site, you agree to these Terms. If you do not agree, do not use the App or Site.

1. Eligibility

You must be at least 18 years old and legally permitted to view gambling-related content in your jurisdiction to use the App or Site. The App is rated 17+ on the Apple App Store. By agreeing to these Terms, you represent and warrant that you meet these requirements.

2. Service Description

The App uses the xAI Grok reasoning model and publicly available race data to generate AI-driven analysis of Australian thoroughbred horse races. For each race, the AI may return a selection, a confidence score (60–100), and a recommended unit size (1–10), or it may return "No Selection" if it does not identify a data-backed edge.

The App does not:

• Facilitate, process, or handle any gambling transactions.
• Connect to TAB, bookmakers, or any betting platform.
• Provide financial advice, investment advice, or legal advice.
• Guarantee any outcome, winnings, or return on investment.

3. No Financial or Gambling Advice

All AI output — selections, confidence scores, unit sizes, and written reasoning — is provided for informational and entertainment purposes only. It does not constitute financial advice, gambling advice, personal advice, or a recommendation under the Australian Corporations Act 2001 or any other law.

Past performance of the AI does not guarantee future results. Race outcomes are inherently unpredictable. You are solely responsible for:

• Your own betting decisions and bankroll management.
• Any financial outcomes (wins or losses) resulting from those decisions.
• Ensuring that any betting you do complies with the laws of your jurisdiction.

5. Subscriptions, Billing, and Refunds

EquiEdge offers auto-renewing subscriptions billed through your Apple ID. At launch these will include:

• Free Trial — 3 track-day analyses over 3 days, no payment required.
• Basic — $14.99 AUD/month or $143.88 AUD/year.
• Pro — $34.99 AUD/month or $347.88 AUD/year.

Prices are in Australian Dollars (AUD) and may be updated from time to time. Any price change takes effect on the next billing cycle and will be notified to you in advance where required by Apple or applicable law.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions through your Apple ID account settings, not through EquiEdge directly.

Refunds: Subscription refunds are handled by Apple under Apple's refund policy. We do not process refunds directly. No refunds are issued by EquiEdge for partial subscription periods.

Track-day limits: On the Basic tier, a "track-day" is defined as analysing one track on one day. Re-analysing the same track on the same day does not count against your weekly limit. Weekly limits reset every Monday at 00:00 AEST.

6. Acceptable Use

You agree not to:

• Use the App or Site for any unlawful purpose or in violation of any law.
• Resell, redistribute, or commercialise AI analysis output (for example, by operating a paid tipster service using EquiEdge output).
• Reverse-engineer, decompile, or attempt to extract the AI prompts or data pipelines underlying the App.
• Use automated scripts, scrapers, or bots to extract data from the App or Site.
• Interfere with the normal operation of the App or Site, or circumvent access controls.
• Share subscription accounts across multiple Apple IDs to avoid subscription charges.

7. Accuracy Disclaimer

While we strive for accuracy, the AI analysis relies on publicly available data that may contain errors or omissions. The AI itself may also make mistakes. We make no warranty that the analysis, selections, confidence scores, or any other output will be accurate, complete, timely, or error-free. The App and Site are provided on an "as is" and "as available" basis.

8. Intellectual Property

All content in the App and on the Site — including text, graphics, the EquiEdge name and logo, the 7-step methodology description, the AI prompt engineering, and all software — is owned by EquiEdge or our licensors and is protected by copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial use for the duration of your subscription. This licence does not include any right to resell or redistribute output.

9. Limitation of Liability

To the maximum extent permitted by Australian law:

• EquiEdge, its directors, employees, and contractors are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App or Site, or from reliance on any AI output.
• This includes, without limitation, betting losses, loss of profits, loss of data, or loss of business opportunities.
• Our total liability to you in any twelve-month period will not exceed the amount you paid to EquiEdge (directly or via Apple) in that period.

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited by agreement.

10. Consumer Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your subscription and obtain a refund for the unused portion; or to compensation for the reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time.

11. Suspension and Termination

We may suspend or terminate your access to the App or Site, with or without notice, if you breach these Terms, if we suspect fraud or abuse, or if we are required to do so by law. On termination, your licence to use the App ends immediately. Cancelling a subscription ends your access to paid features at the end of the current billing period.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be signposted on this page with a new "Last updated" date. Where required by law, we will give you reasonable advance notice before the changes take effect. Continued use of the App or Site after the effective date of the new Terms constitutes acceptance of those Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. You and EquiEdge submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms.
